Are you a strategic thinker with a passion for project excellence? Join Sunwater as Commercial & Contracts Manager, where you'll play a vital role providing expert advice and management of the Engineering and Professional Services Partner (EPSP) long term, collaborative agreement. Reporting to the Executive General Manager - Engineering & Water Resources, you will be responsible for providing commercial and contractual oversight and governance of the agreement to ensure the delivery of value for money for Sunwater.

As a Commercial & Contracts Manager at Sunwater, you will:

  1. Foster a constructive working relationship with the EPSP to ensure collaborative and commercial outcomes are achieved as defined in the Agreement.
  2. Provide the EGM advice and recommendations in relation to the EPSP framework, contractual performance, risk & contingency management and variations.
  3. Provide commercial and contractual oversight and governance of EPSP to ensure the delivery of value for money for Sunwater including undertaking Pain-share and Gain-share calculations and payments in accordance with the contract.
  4. Manage the reviewing and negotiating of variations to the agreement and any other Sunwater contracts for the arrangement.
  5. Review and evaluate claims and submissions by the EPSP under the contract, make recommendations and prepare all associated contract documentation.
  6. Actively drive change management and dispute resolution across EPSP and Sunwater.
  7. Manage key performance indicators and qualitative and quantitative metrics to capture, report and evaluate the benefit and performance of all activities of the agreement.

We are seeking a talented individual with proven commercial and contractual acumen, including management of collaborative contract frameworks and have a demonstrated understanding of commercial and financial risks within the engineering/construction environment. You will hold tertiary qualifications in Business, Quantity Surveying, Procurement, Law, Engineering or Construction Management, and have significant experience working with open book contractual arrangements and experience in interrogating open book claims. You will also bring:

  1. Commercial & Contractual acumen: Experience in complex value and time-based analytics, claims mitigation and negotiation.
  2. Performance management: Support development of, and monitor, key performance indicators and qualitative and quantitative metrics to capture, report and evaluate the benefit and performance of the collaborative arrangements.
  3. Communication skills: Extensive interpersonal and communication skills with a proven ability to develop and maintain effective commercial client relationships in complex project management models.
