The team

The Legal Services Team is responsible for the delivery of legal services across ASIC and is instrumental in driving ASIC's reputation as a modern and effective regulator and enforcement authority. Legal Services is led by the General Counsel, Executive Director and comprises the following teams: Enforcement Legal Services, Regulatory Legal Services, Corporate Legal Services, the Hearing Delegates Panel, and the Legal Operations Team.

The Criminal Law Team is expected to couple legal expertise with a contemporary approach to the delivery of legal services, including through the embrace of continual improvement, innovation, building efficient capability and the use of technology to optimise execution.

The Criminal Law team provides advice, guidance and assistance on all aspects of ASIC's investigation of criminal offences and the prosecutions of those offences, including policies relating to the exercise of ASIC's information gathering powers. The team plays a lead role in engaging with the Commonwealth Director of Public Prosecutions (CDPP). The team also consults with stakeholders and provides advice on legislative reform relevant to information-gathering powers, investigations, criminal offences and criminal procedures.

The role

As a Senior Criminal Lawyer, you will be responsible for:

  • Specialist Legal Advice: Provide guidance on offences against ASIC-administered legislation and other relevant laws, including information gathering and evidence sufficiency.
  • Collaboration with CDPP: Work with the CDPP on complex white-collar crime prosecutions, including sentencing hearings and appeals.
  • Case Management: Independently manage a significant caseload, assist with summary prosecutions, and conduct early guilty plea negotiations.
  • Policy and Practice Development: Review and develop criminal law policies within ASIC, and advocate for legislative reforms.
  • Stakeholder Engagement: Support relationships with the CDPP, Attorney-General's Department, and other stakeholders.
  • Team Development and Innovation: Foster a culture of continual improvement, innovation, and capability building within the team, and collaborate with other ASIC functions to optimize execution.

About you

The ideal candidate must be admitted to practice in an Australian jurisdiction and eligible to hold at least a Restricted Government Legal Practising Certificate. You should have significant experience in complex criminal investigations and enforcement activities, particularly in white-collar and corporate crime. This expertise is crucial for effectively handling the responsibilities of the position. You will also demonstrate:

  • Strategic Case Management: Experience in managing major criminal cases strategically.
  • Criminal Law Expertise: Strong knowledge of criminal law, procedure, and rules of evidence.
  • Interpersonal Skills: Ability to build relationships, negotiate, and consult effectively with stakeholders.
  • Communication Skills: Excellent verbal, written, and presentation abilities.
  • Organizational and Adaptability Skills: Strong time management, organizational skills, and the ability to adapt to changing priorities in a fast-paced environment.
